These Terms and Conditions apply between you and International Web & Distribution Services

By using this website or placing an order through www.hivtest.eu, you agree to these Terms and Conditions. If you place an order with us, a contract of sale is formed once we have accepted your order.

Introduction

These Terms and Conditions govern your use of www.hivtest.eu and the purchase of products offered through the website.

When you place an order through www.hivtest.eu and we confirm that your order has been accepted, a contract of sale is formed between you and International Web & Distribution Services (IWDS). That contract is governed by these Terms and Conditions and any mandatory rights that apply under consumer law.

Terms of Sale

1. Basis of Order and Acknowledgement

  • These Terms of Sale apply to offers, orders and contracts relating to products sold through www.hivtest.eu.
  • By placing an order, you confirm that the information you provide is accurate and complete.
  • You must be at least 18 years old and legally capable of entering into a contract under the laws applicable to you.
  • Receipt of an order does not automatically constitute acceptance of that order. A contract becomes effective once we have confirmed acceptance of the order.
  • We may refuse an order where there is a legitimate reason to do so, including suspected fraud, incorrect information, product unavailability or an obvious pricing or product-information error.

2. Product Descriptions and Prices

We make reasonable efforts to ensure that product descriptions, specifications, prices and availability shown on the website are accurate and up to date.

Product appearance, including colour, may vary slightly from what is displayed on your screen. Where product information supplied by the manufacturer or contained in the official Instructions for Use (IFU) is relevant to the safe and correct use of a product, that information should always be followed.

We may correct errors or update product information on the website at any time. Such changes will not affect an order that has already been accepted, unless the change is required for safety, legal or regulatory reasons.

3. Prices and Payment

The price payable for a product is the price displayed at the time the order is placed, unless an obvious pricing error has occurred.

Any applicable taxes, shipping charges or other costs will be displayed during the ordering process before you complete your purchase.

You agree to provide current, complete and accurate billing and payment information. We may refuse or cancel an order where payment cannot be authorised or where we reasonably suspect fraudulent activity.

4. When Orders May Not Be Accepted

We may be unable to accept an order if, for example:

  • the product is unavailable;
  • the payment cannot be authorised;
  • the information provided with the order is incomplete, incorrect or suspected to be fraudulent;
  • there is an obvious error in the product description or price;
  • we are unable to deliver to the requested destination;
  • legal or regulatory restrictions prevent us from supplying the product; or
  • we have reasonable grounds to believe the products are being ordered for unauthorised resale.

If we are unable to accept an order after payment has already been received, we will refund the amount paid for the affected products.

5. Cancellation by IWDS

In exceptional circumstances, IWDS may cancel an order after it has been accepted but before delivery. This may occur where, for example:

  • a product unexpectedly becomes unavailable;
  • a supplier is unable to supply the product;
  • an obvious error in product information or pricing is discovered;
  • legal or regulatory requirements prevent us from completing the order; or
  • an event beyond our reasonable control prevents fulfilment of the order.

If we cancel an accepted order, we will notify you and refund any amount already paid for the cancelled products. Nothing in this section limits any mandatory rights you may have under applicable consumer law.

Right of Withdrawal and Returns

6. Statutory Right of Withdrawal

If you are a consumer purchasing online and the statutory right of withdrawal applies to your order, you generally have the right to withdraw from the purchase within 14 days without giving a reason.

For goods, the withdrawal period normally begins on the day on which you, or a third party designated by you, receives the goods.

To exercise your right of withdrawal, you must inform us of your decision within the applicable withdrawal period by means of a clear and unequivocal statement.

After notifying us of your withdrawal, the goods must be returned without undue delay and, where required by law, no later than 14 days after notifying us of your decision to withdraw.

7. Return Costs and Refunds

Unless we have expressly agreed otherwise, you are responsible for the direct cost of returning goods when exercising the statutory right of withdrawal.

Where the statutory right of withdrawal applies, we will refund the payments that we are legally required to refund, including the cost of our least expensive standard delivery option where applicable.

Refunds will be processed without undue delay and within the period required by applicable law. We may withhold reimbursement until we have received the returned goods or you have provided evidence that the goods have been sent back, whichever occurs first.

Any additional delivery costs resulting from your choice of a delivery method that is more expensive than our standard delivery method do not have to be refunded where permitted by law.

8. Health and Hygiene Products

Certain sealed products may be excluded from the statutory right of withdrawal where they are not suitable for return for genuine health-protection or hygiene reasons and the seal has been broken after delivery.

This exception is only applied where the legal requirements for the health or hygiene exception are met. Opening ordinary outer shipping packaging does not by itself remove a statutory right of withdrawal.

Your statutory rights relating to faulty, damaged, unsafe or non-conforming goods are not affected by this exception.

Availability and Delivery

9. Product Availability

All products are subject to availability. We may temporarily or permanently withdraw products from sale where necessary.

If a product becomes unavailable after you place an order, we will inform you as soon as reasonably possible and, where appropriate, refund any amount already paid for that product.

10. Delivery

Any delivery or dispatch times displayed on the website are estimates unless we have expressly agreed a specific delivery date with you.

Delivery may occasionally be delayed by circumstances such as carrier delays, customs procedures, public holidays, extreme weather, supply problems or other events outside our reasonable control.

Where mandatory consumer law gives you additional rights because of delayed or failed delivery, those rights remain fully applicable.

11. Passing of Risk and Ownership

Where you purchase as a consumer, risk in the goods passes to you when you, or a third party designated by you other than the carrier, physically receives the goods, except where applicable law provides otherwise.

Ownership of the goods remains with IWDS until full payment for those goods has been received.

Legal Guarantee and Faulty Products

12. Statutory Guarantee

Products supplied by us must conform to the contract and meet the standards that you may reasonably expect under applicable consumer law.

If a product is faulty, damaged, incomplete or does not correspond with the description provided at the time of sale, you may be entitled to a repair, replacement, price reduction or refund depending on the circumstances and the applicable law.

Consumers in the European Union have statutory guarantee rights. These rights provide a minimum level of protection and may be supplemented by additional rights under national law. In the Netherlands, the statutory conformity period may depend on how long a consumer can reasonably expect the particular product to function properly.

Any manufacturer's warranty or other commercial guarantee is additional to, and does not replace or restrict, your statutory consumer rights.

Damage caused by misuse, improper storage, failure to follow the product instructions, intentional damage or normal wear and tear is not considered a product defect where the law permits such distinction.

Liability

13. Our Responsibility

Nothing in these Terms and Conditions excludes or restricts liability where doing so would be unlawful. This includes liability that cannot legally be excluded or limited under applicable consumer law.

We are responsible for foreseeable loss or damage caused by our failure to comply with these Terms or by our failure to exercise reasonable care and skill where required by law.

We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded.

If you use the website or purchase products wholly for commercial, business or resale purposes, different rules may apply and consumer protections may not be available to you.

Always read and follow the official Instructions for Use (IFU) supplied with the specific test. Product-specific instructions, limitations, reading times and interpretation requirements may differ between tests.

A reactive HIV self-test result should not be treated as a confirmed HIV diagnosis. Further confirmatory testing through an appropriate healthcare provider or testing service is required.

A non-reactive result must be interpreted in relation to the type of test used, its applicable window period and the timing of the possible exposure.

18. Accuracy of Website Information

We make reasonable efforts to ensure that the information published on the website is complete, accurate and current.

If we become aware that medical, regulatory or product information is outdated or incorrect, we may update or correct that information.

23. Events Beyond Our Reasonable Control

IWDS will not be responsible for delay or failure to perform an obligation to the extent that the delay or failure is caused by circumstances genuinely outside our reasonable control.

This may include events such as natural disasters, war, governmental restrictions, major transport disruption, widespread technical failures or other comparable circumstances.

Nothing in this section removes any mandatory consumer rights that continue to apply despite such circumstances.

We may update these Terms and Conditions from time to time, including where changes are necessary for legal, regulatory, security or operational reasons.

The Terms and Conditions applicable to your purchase are normally those in force at the time your order is placed, unless applicable law requires otherwise.

25. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary.

These Terms and Conditions and contracts entered into through www.hivtest.eu are governed by the laws of the Netherlands.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer-protection rights that apply to you under the law of your country of habitual residence.

Any dispute will be submitted to the competent court determined under applicable law. Nothing in these Terms restricts a consumer's right to bring proceedings before another competent court where mandatory consumer law provides that right.
